- Introduction
Welcome to Balans Studios. By booking a class, purchasing a class pack or one of our other services, or visiting our website or Studio, you are confirming that you have read these Terms and agree to be bound by them. These Terms together with the items listed below constitute a contract of membership between you (the client) and us (Balans Studios). Please ensure that you read and understand these Terms before attending any class at the studio.
- Definitions
- We/Us/Our: Refers to Balans Studios, operated by Balans Studios Ladies Health Club LLC.
- You/Your/Yours: Refers to you, the client.
- Account
In order to use our services, you will have to create an account with your own profile with Balans Studios. This can be done either on our website or on our app. You must always only use your own account, and may never use another person’s account without their and our permission. You are solely responsible for the activity that occurs on your account, and you must keep your passwords secure.
- Booking Classes
The cost of each regularly scheduled class is set out in our class packs section. If we have agreed a specific arrangement with you, we will honor that as agreed (for example, this may include an additional discount for any of our multi-class packs which are billed on a monthly recurring basis). Additional classes, workshops, and events hosted outside of our regularly scheduled classes may be paid for at the time of booking either on our website or app or in the studio before the class’s start time. Some classes, workshops and events will require payment immediately at the time of booking and will indicate such during the booking process. Our physio services will be paid at the time of booking either on our website or app, or in the studio before the start time.
- Payment Options
Payments are only accepted by card; either through our website or app, or in the studio. We do not accept cash or any other form of payment.
- Class Packs
You can purchase our 5, 10, or 20 class package, online or in person.
- 5 class passes must be used within a 1-month period of the activation date; any unused credits will expire after this period.
- 10 class passes must be used within a 2-month period of the activation date; any unused credits will expire after this period.
- 20 class passes must be used within a 3-month period of the activation date; any unused credits will expire after this period.
Packs cannot be suspended or extended. You may not share any of our 5, 10, or 20 class packs; these are for individual use only.
Cancellations and Refunds
- Cancelling Your Booking
You may cancel your booking without charge up to 24 hours before the start time of the class by logging into your online account and following the steps to early cancel. Canceling a class booking must be done via your online account. Voicemails, emails, or texts do not guarantee a change to your reservation before the 24-hour time frame needed.
- Late Arrivals and No Shows
You must arrive at least 5 minutes prior to the start of each class or service. We take starting on time very seriously to ensure your and all our other clients’ experiences are as smooth as possible. Late arrivals are not guaranteed participation in the class, whether pre-registered or not. A no-show is a pre-registered student that did not attend class and did not early cancel for the class. No-shows result in a loss of class credit.
- If We Cancel a Class or Event
In the event that we cancel a class or event that you have already booked, we will contact you by email or telephone to let you know. We will refund your credit for the class or event, so that you can select any alternative class or event at another time to book.
- Pricing Changes
We reserve the right to review, and may choose from time to time to change, the prices of our classes, services, class packs and memberships. If you have paid for any class packs or memberships in advance, you will not be required to pay any increase in prices, until your pre-purchased credits have been used or expired. Any classes or services purchased thereafter shall be at the increased rate, if applicable.
- Non-Payment
- If you have agreed to a recurring class pack membership, but your account becomes overdue or payment is not received on renewal, we reserve the right to refuse you entry into our studio or the relevant class or service, until the overdue sums are paid in full.
- Minimum Age & Eligibility
Membership is void where prohibited. Our studio is an adults only venue, and this also extends to the use of our website and our app. Any registration by, use of or access to the website by anyone under 18 is unauthorized, unlicensed and in violation of these Terms of Use. By using Balans Studios Services or the website, you represent and warrant that you are 18 or older and that you agree to abide by all of the terms and conditions of these Terms of Service.
- Personal Belongings
We take no responsibility in any way for the safekeeping of your personal belongings while you are present in our Studio (whether these are kept on your person, left unattended, left in our premises or left in our lockers which are provided). Our lockers are provided for convenience only, and we do not guarantee the safeguarding of your personal belongings. You assume all risk of loss for any personal belongings.
- Safety, Hygiene & Etiquette
Clients are requested to wear an appropriate form of dress for their exercise; for our exercise classes in our Pilates & yoga rooms, you should not attend sessions barefoot and instead use grip socks, which are mandatory for all classes.
Mobile phones are not permitted to be used during classes or services, including texting, taking calls, using social media or filming videos. You may take photos only if other clients are not shown or they have consented to their photos being taken.
No food or drinks are permitted in any part of the Studio other than in the reception room. Other than with the exception of guide dogs, no pets are permitted in the Studio.
Smoking or vaping is forbitten in the Studio at all times.
- Wellbeing
Balans Studios is committed to the safety and welfare of all our clients and staff. We will not tolerate unreasonable, threatening, obscene, harassing, indecent, or illegal behavior. We have the right to judge behavior and respond accordingly, including termination of membership and/or cancellation of class passes without refund for any student engaging in unacceptable behavior. Clients who do not observe our policies or who abuse equipment will be asked to leave; we reserve the right to terminate memberships or class passes of anyone who refuses to observe any of these Terms.
- Retail Purchases
Retail purchases made at the studio cannot be refunded. Retail purchases (of non-perishable goods) may, if (in our judgment) unused, unopened, in original packaging, and with retail tags, be eligible for exchange within 14 days of purchase. Retail “Sale” items that are discounted are final sales and may not be returned.
- Mobile Services and Third Party Sites
Our services may include services which may be accessible via your mobile phone or online. We do not charge for these services; however, this remains subject to your carrier’s or internet service provider’s messaging, data, internet and other rates and fees, which we do not take any responsibility for. Our services may contain links to, or use the platforms of, third parties; we do not control these and we do not take any responsibility for any issues that may be caused by or in connection with them.
- Intellectual Property
The contents on our website, our app, our social media accounts, and those located in our Studio, including without limitation any text, software, scripts, graphics, photos, sounds, music, videos, interactive features, know-how, logos, fonts, trademarks, service marks and any other similar intellectual property, are owned by or licensed to Balans Studios, subject to copyright and intellectual property rights under law. Any content you may have access to is provided only for your information and personal use and may not be downloaded, copied, reproduced, distributed, transmitted, displayed, sold or otherwise exploited for any purposes whatsoever.
- Termination
We may terminate your access to the Studio, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement (and the Waiver) that by their nature should survive termination shall survive termination, including without limitation, ownership provisions, warranty disclaimers, indemnities and limitations of liability.
- Term
These Terms of Service shall remain in full force and effect while you use the Balans Studios services. You may terminate your membership at any time, for any reason, by following the instructions on your profile or by contacting our studio directly via phone or email. Balans Studios may terminate your membership at any time, without warning, if you breach these Terms of Service. Even after membership is terminated, these Terms of Service will remain in effect.
- Entire Agreement & Change to Terms
These Terms of Service, together with our Privacy Policy, and any other legal notices published by Balans Studios on our website, shall constitute the entire agreement between you and Balans Studios concerning our website. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and Balans Studios failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. Balans Studios reserves the right to amend these Terms of Service at any time and without notice, and it is your responsibility to review these Terms of Service for any changes. Your use of the Balans Studios website following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms.
- Force Majeure
We shall not be liable to you or be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms, if the delay was due to any cause beyond reasonable control, including, but not limited to, Acts of God, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), IT viruses, difficulties in obtaining raw materials, labor, fuel, parts or machinery, power failure, or breakdown in machinery.
- Waiver
Access to our Studio and to any of our classes or services is conditional upon your signing of our Waiver, which has been presented to you upon the creation of your profile with us on our website or app. If you have not signed the waiver, access may be denied or revoked. Notwithstanding the foregoing, any access to our Studio or use of our services without having signed our Waiver shall be deemed to be subject to the terms of our Waiver as if this has been executed.
- Governing Law
This Agreement (and any further rules, policies, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Dubai, UAE, without giving effect to any principles of conflicts of law.
